Recognition of Foreign Divorce Judgments in Georgia
Advice on using a divorce decision issued abroad in Georgia and preparing the supporting records for the relevant authority or court.
Before applying for recognition, establish what the foreign decision says, whether it is final and what it will be used for in Georgia. A decision dissolving the marriage, a property award and a child-related order can raise different recognition or enforcement questions.
Start with the purpose of the document
Explain whether you need to update a civil record, establish marital status, remarry or enforce an obligation. Supply the complete decision and any certificate confirming that it has become final. An extract or summary may omit information needed for the Georgian assessment.
We also ask for the spouses’ citizenship at the time of the foreign decision, their current circumstances and any connected proceedings. Those facts can affect whether a recognition application is needed and which procedure should be used.
Checking whether recognition is required
Georgia’s Private International Law regulates recognition of foreign judgments and contains specific provisions for marriage decisions. Article 69 provides an exception where both spouses were citizens of the country whose institution issued the decision at the relevant time. Its application should be checked against the actual decision and the spouses’ circumstances.
Where a recognition application is required under that law, the Supreme Court of Georgia considers the question. A legal assessment should therefore come before arranging an application or assuming that certification alone is sufficient.
Finality, notice and competing decisions
The papers should show whether the decision is legally effective and whether the other party received the required notice. Keep any proof of service, acknowledgment, response or document recording participation in the foreign proceedings. Tell us about an appeal or an application to reopen the case.
Also disclose Georgian proceedings or another decision about the same dispute. The law contains grounds on which recognition may be refused, so these points should be examined before filing.
Certification and Georgian translation
Once the document set has been checked, we confirm the required copies, apostille or legalization where applicable, and Georgian translation. A certificate of finality, proof of service and the judgment itself are separate documents and may need to be obtained from different parts of the foreign court administration.
Send scans before commissioning translations. This helps identify missing pages and differences in names or dates that would otherwise be repeated in the translated record.
Property, maintenance and child-related orders
Recognition of the divorce itself should be considered separately from steps needed to enforce a payment, transfer an asset or give effect to arrangements for a child. A single foreign judgment can contain several types of order, each requiring its own assessment.
Provide the full operative part and explain what has already happened under the order. For connected matters, see marital property division, child support and child residence and contact.
Using a Georgian divorce decision abroad
If the decision was issued in Georgia and is needed overseas, the receiving country’s rules govern its use there. We can help obtain the Georgian documents and coordinate with the foreign lawyer or authority about certification and translation.
Tell us the destination country and the purpose before ordering documents. Our international divorce guide explains the wider preparation for cases involving more than one country.
